When it comes to contracts, technicalities matter! Our Buyer wanted to ask for the HVAC to be serviced after their home inspection recommended further evaluation. But just asking for the system to be serviced is ambiguous, and the Seller could have argued that what they did (having the furnace serviced for a defective blower fan) would have satisfied their obligation; even when it turned out that the rest of the system needed to be replaced.
By including the words "to ensure proper function and safety" in our repair request, we were able to ensure our client received a brand new HVAC system as part of their purchase.
